{"id":4343,"date":"2023-01-26T13:27:03","date_gmt":"2023-01-26T13:27:03","guid":{"rendered":"https:\/\/spicemedia.ug\/spicefm\/?p=4343"},"modified":"2023-01-26T13:31:07","modified_gmt":"2023-01-26T13:31:07","slug":"failed-relationship-court-orders-woman-to-refund-ugx-10-43m","status":"publish","type":"post","link":"https:\/\/spicemedia.ug\/spicefm\/2023\/01\/26\/failed-relationship-court-orders-woman-to-refund-ugx-10-43m\/","title":{"rendered":"Failed Relationship: Court Orders Woman to Refund UGX 10.43M"},"content":{"rendered":"<p>By URN<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-4345 alignleft\" src=\"https:\/\/spicemedia.ug\/spicefm\/wp-content\/uploads\/sites\/2\/2023\/01\/index-1.jpg\" alt=\"\" width=\"300\" height=\"168\" \/>Kanungu Grade One Magistrate&#8217;s court has directed a woman to refund Shillings 10.43 million she recieved from her ex-lover toward her education\u00a0after turning down his marriage proposal.\u00a0The ruling statements from\u00a0civil suit number 024 of 2022 filed by\u00a0Richard Tumwiine in February 2022 against his ex-lover Fortunate Kyarikunda\u00a0for breach of marriage promise.<\/p>\n<p>According to the prosecution, Tumwiine met Kyarikunda at Kiringa primary school in Kambunga sub-county, Kanungu district where he was a teacher in 2015.\u00a0\u00a0Kyarikunda\u00a0was conducting teaching practice at the same.\u00a0In the process, Tumwiine fell in love with Kyarikunda and agreed in 2018 to get married.<\/p>\n<p>Tumwiine reportedly gave Kyarikunda Shillings 9,439,100 to complete her Diploma in legal practice at the Kampala-based Law Development Center-LDC.\u00a0After completing her bar course, the lovebirds agreed on\u00a0January 10, 2022, to arrange an\u00a0introduction ceremony scheduled for February 2022.<\/p>\n<p>However, Tumwiine was shocked in February 2022 when Kyarikunda backed out of the marriage plan, saying that she can&#8217;t proceed because\u00a0her suitor is above 65 years of age yet she is below 35 years. In his petition, Tumwine accused\u00a0Kyarikunda\u00a0of breach of marriage promise. He asked the court to compel her to refund the money he injected into her education since he did it well knowing they will end up together.<\/p>\n<p>In her ruling on Wednesday, the Kanungu Grade One Magistrate,\u00a0Asanansio Mukobi, said that they despite being served,\u00a0Kyarikunda\u00a0failed to file her defense.\u00a0Mukobi says that since the marriage promise was not fulfilled, Tumwiine is entitled to the reimbursement of the Shillings 9,439,100 he spent on her.<\/p>\n<p>Based on article 126 (2) (c) of the Constitution of the Republic of Uganda 1995 as amended, which provides for adequate compensation for victims of wrongs, Mukobi ordered Kyarikunda to pay Shillings 1,000,000 to Tumwiine as general damage for inconveniences and psychological anguish.<\/p>\n<p>&#8220;There is no wrong without a remedy. Victims of wrongs such as the plaintiff in this case are entitled to compensation,&#8221;\u00a0reads the ruling.\u00a0Efforts to get a comment from Kyarikunda were futile.
